Parking Companies Responsible for Vechicles

The Supreme Court has just passed a verdict ruling that vehicle parking companies should be fully responsible for any cars and or motorcycles that is stolen in the building or compound of parking that it managed.

This decision is very fair, because until now such parking companies charged cars/motorcycles with hourly parking rate only for the rental of parking space, but refuse to take responsibility for partial or total loss of car/motorcycle.

However, the Association of Shopping Center is not happy with this verdict, saying that the parking companies only provide parking spaces and do its best to prevent any stolen vehicles but cannot be asked to be responsible for them.

In connection with this verdict, the government of Jakarta plan to amend its by-law regarding Parking, among others by requiring parking companies to get insurance protection for all the vichicles parking in their area.

Thats interesting news Harry. I expect that the cost of parking will increase significantly if the lot owners were forced to buy insurance to protect against theft. I don't own a car here but is personal auto-theft insurance unavailable in indo?

Hi Pj,
Yes the owner of parking lot might increase the rate but cannot be so high.
Re: personal auto-theft insurance is available, but the Supreme Court wants the lot owner to be responsible for loss.

if the companies are taking responsiblity, they might work and guarding harder.

but just hope the fees wont increase..they just hv to serve more efficiently to prevent loss anyway

It means the parking rate will rise and they will be responsible for any losses suffered by the owners of the vehicles. There are both bad and good news about it. The bad news of course there will likely be protests amongst the owners of the vehicles, and the good news is it will encourage people to use public transportation, of course it means it can be a healthier environment if lots of people switch to public transportation...

Hi Yari,
Although rise in parking rate intended to guarantee safety of vehicle via insurance but it would surely be protested, especially now prices of commodities are rising high.
Re: public transportation, I am afraid it would not be a short term solution. Increasing number of buses etc would not be effective if the roads are still the same.

This could work, and if it passes, I can only immagine how long the ownner of the car will wait for a payout from the companie insurance.
They'll fight it with tool and nail!

If the parking companies have taken reasonable steps to ensure the safety of the vehicles parked in the premises (e.g. cctv etc) the insurance companies have to pay anyways.May even ensure safety for car owners to a certain extent.

I agree on regulating the fees in the parking lots especially in the shopping malls, I agree with holding the companies at least partially responsible for crimes committed (they do have security personnel around), but I disagree on any fees hike. Insurance companies would be laughing all the way to the bank... the authority must figure out a win-win solution.

Well, I think they should be held responsible for any vehicles stolen from their lot. You park there under the assumsion your car will be kept safe, to a degree at least. Also, rate hikes don't always equal better service.

The authorities should study how it is done in other cities incl. Kuala Lumpur.
