Manohara vs. the Kelantan Prince

The High Court of Kuala Lumpur, Malaysia, today awarded the Prince of Kelantan, Tengku Fakhry, the sum of  US$ 1.8 Million in Defamation Lawsuit against his teen Indonesian wife Manohara Adelia Pinot.

The Jakarta Globe quoted Tengku Fakhry's lawyer Muhamad Haaziq as saying that the said High Court verdict was passed in the absence of Manohara as Defendant who never appear during the who trial.

The Jakarta Globe also reported that considering that the Indonesian Laws cannot compel Manohara to adhere to the Malaysian High Court ruling, therefore the Prince plans to fly to Jakarta next week to file a similar lawsuit based on the Indonesian laws.

Due to the fact that there have been too many stories about Manohara, her Mom and the Prince reported by the media and bloggers for so long, I prefer not to give any comment until there is further development of this case.

Manohara again

One of the most dramatic news reported by the Indonesian media     last year was the strange marriage between Indonesian-American teenager Manohara (17) and Prince Fakhry (32) of Kelantan, Malaysia.

The relationship ended after Mano ran away from her husband, and each of them initiated legal actions against the other. But, considering that such actions were taken in each of their own countries, therefore none of them became legally effective.

Afterward, Mano played in an highly paid Indonesian TV Sinetron (soap opera) which was not popular as expected. Beside that, she also tried to maintain popularity by taking part in anti corruption demonstration and other high profile activities.

And recently, KapanLagi.com reported about photos of a person who looks like Mano with a man only described by his initial AM. But someone at Mano's home said that the are not photos of Mano.

Considering that the legal status of her marriage is still unclear, I wonder how will her husband Prince Fakhry will react when he find out about the above photos.

Manohara's Mom's New Enemy

Since Indonesian-American model Manohara Odelia Pinot (17) left her husband Tengku Fakry, Prince of Kelantan Kingdom, Malaysia, last May, the media have been reporting about her and her Mom Daisy Fajarina every day.

The reports were so massive that my sympathy toward Manohara eroded, especially after she seemingly favored publicity and highly paid film contract than prepare legal action against her husband for the alleged horrible treatments that he gave to her during their short lived marriage. Due to which fact, I have been avoiding any stories about her since then.

Last Saturday, my interest on this case returned after TV stations reported about a 25 years old woman, Shaliha Lanti, who told reporters that she has been brutally treated by Manohara’s Mom when she lived with them for around 10 years in France. Saliha said that Daisy took her from a small town in South Sulawesi and promised that she will be sent to school abroad. However, Daisy has made her as a Servant. At first, Daisy was kind to her, until her French husband Noack Pinot showed interest on her & abused her sexually. Instead of protecting Saliha, Daisy have tortured her.
In 2007 a French Court sentenced Noack Pinot to four and a half month imprisonment for the Sexual Abuse, and Daisy 18 months imprisonment for the Torture and Providing Inhuman Working Condition since 1998. However, Daisy never went to jail because she left France.
Saliha explained that she wants Daisy to return to France and serve the Court sentence.

Earlier, on 23 July 2009, Shaliha and her lawyer have reported with the National Police headquarters in Jakarta, about Daisy's above alleged Torture based on our Penal Code Art. 361 and the Domestic Violence Eradication Law No. 23/2004 Art. 44.

In reaction to Shaliha's above allegations, Daisy Fajarina told TV reporters that
Shaliha is her foster daughter therefore her family never treated her as a Servant, and Shaliha's allegations were not true.

For details on the above media reports, please click here, here, here and here.

Considering the above, it would be very interesting to know how Manohara and her Mom would end up.

Manohara's Update

Last Tuesday, 9 June 2009, Manohara Odelia Pinot (17) filed a report with the National Police about the Torture & Rape committed against her by her husband Prince Fakhry (31) of the Kingdom of Kelantan, Malaysia. (Photo:courtesy of Detik)

Detik reported that Manohara was accompanied by her mother and attorneys a.o Hotman Paris Hutapea. According to Mano, she also reported the King and Queen of Kelantan, Aircraft Pilot Zakaria, Ichsan (Indonesian), the bodyguard of Fakhry i.e. Soberi & wife.
Hotman Paris said that they were accussed of committing 11 crimes stipulated by our Penal Code a.o Art 285 (Rape), Art. 333 (Kidnapping), which carry total punnishment of 70 years imprisonment.
Afterwards, Manohara went to the RSCM General Hospital for Foresic Tests. After the test Forensic Expert Dr. Mu'nim Idris said that Mano has suffered a Second Degree Violence causing serius wounds.

According to Suara Karya, the Police Spokesman Abubakar Nataprawira said that the Indonesian cannot process the case because the location of crime was not in Indonesia, but in Kelantan, Malaysia. He suggested that she go to the Department of Foreign Affairs to follow up the case to Malaysia.
In this regards, spokesman of the Dept. Foreign Affairs Teuku Faizasyah suggested Mano to file a report with Malasian Police, for which purpose the Department shall provide assistance.

Meanwhile, the New Strait Times reported that Prince Fakhry has lodged also lodged a report with the Police in Kuala Lumpur last Thursday, 11 June denying allegations made against him by Manohara, her mother and other parties.

The above result of Police report has actually been predicted by Mano's ex lawyer O.C. Kaligis who resigned because Mano has not been serious in taking action against her husband. He said that since her return on 31 May, instead of taking forensic test, Mano & her mother prefered to be busy talking to the media.

Manohara Returns

After several months living under the captivity of her husband i.e. Crown Prince Fakhry of Kelantan Malaysia, Manohara Odelia Pinot was finally allowed to return to Jakarta, this morning (photo: courtesy of Detik).

Detik reported that the 17 years old beautiful model was fetched by her mother Daisy Fajarina and sister Dewi Sri Asri at Hotel Royal Plaza in Singapore, and took her back to Jakarta.
Meanwhile, the spokesman of our Foreign Affairs Department i.e Tengku Faizasyah was quoted as saying that his office has sent a diplomatic note to the Malaysian government regarding Manohara’s case. He added that our Ambassador has met with people from the Sultanate of Kelantan who promised to let Manohara meet her family. He also added that our Embassy helped arranged Manohara’s departure from Singapore, which also involved the local Police.

The release of Manohara gives some valuable lessons for her family, for other Indonesian citizens and government and also for Malaysia, especially the Sultanate of Kelantan.
For her family, especially her mother, this is a lesson for allowing a very young teenager (16 years old) marries a much older foreign man whom neither her daughter nor she knew well. For other Indonesians, we should not be easily tempted to live & work abroad without clear legal status. And for our government, to provide better advocate to those who want to travel, live and work abroad.
Whilst for Malaysia, whose head of state is chosen from amongst the Sultans every 5 years, its people & central government should be very careful because as Crown Price of Kelantan, Fakhry would be the future Sultan of Kelantan and has a chance to be a head of state one day. If that happens, I am sure that it is not only our people and government who would not forget about his behaviors, but also people and government from other countries as well.

Parental responsibilities

I always believed that parents all over the world played a very dominant role in the development of their children who are under the age of 18 years old, due to which fact they have to be fully responsible for their children.

However, there are certain conditions in which some parents want to be free of their natural responsibility for their children .
And that's perhaps what Madlyn Primoff, a New York lawyer, has in her mind when she kicked her 10 and 12 years old daughters out her car one Sunday.
According to the New York Times, at that time Ms. Primoff was so frustrated with her two daughters who would not stopped bickering, that after driving 3 miles from her home in downtown White Plains, N.Y., she kicked those children. She was later arrested by the Police on charges of endangering the welfare of children, and stayed overnight in jail and released after she paid a bail of US$ 1,500.00 and has to return back to the Court on 21 May 2009.

Beside that, in Indonesia currently there has been controversial news reports about a woman i.e Daisy Fajirina, who has allowed her own 16 years old beautiful daugther i.e. Manohara, to be married last August to a 30 years old Prince of Kelantan, Malaysia, whom she and her daughter barely knew. Daisy is currently complaining to the news media that Manohara (now 17) has been brutally mistreated by her husband (now 31), and she therefore demanded our government and everyone else to help her get her daughter back.

Although I symphatize with Daisy in facing her problem, however considering that our Mariage Law No 1/1974 stipulated that Indonesian under the age of 21 years old can only be married if their parents permit them to do so, therefore I believed that she played a very dominant role in the problem that her daughter is facing now.

I am very sad to know that some parents can be very devastated in handling their children. I believed that if parents would always stick to their responsibilities, they would not have very bad problems with their children.

Manohara & the Prince of Kelantan

Every year, the Indonesian people celebrate the 21st of April as the birthday of Kartini i.e. a lady whose ideas have made the status of Indonesian females equal to the males.

But yesterday, the celebration was disturbed by a very strange news about the kidnap of a 17 years old Indonesian model i.e Manohara Pinot, by Tengku Muhammad Fakhry (31) Prince of Kelantan, Malaysia, who happened to be her own husband.

According to KapanLagi, the couple was married on 26 August 2008 not long after they met, when Manohara was only 16 years old and the Prince was already 30 years old. Apparently, their marriage did not go well, because the Prince turned out to be a brutal, high tempered, possessive & sex maniac who’ll ruthlessly beat his wife if he did not get what he wants. His brutality include slashing Manohara’s breast with a razor. Obviously, Manohara cannot stand it any longer, so at the end of December 2008 she runnaway to her mother in Jakarta.

According to Oktavita, the prince then made efforts to restore the shattered relationship with his wife and family and get Manohara back. In early March he took them all to Mecca, Saudi Arabia, for an Umrah Pilgrimage. Then on the way back to Jakarta, as they transited in Kuala Lumpur airport, four of the prince’s men snatched Manohara out of the airport.

Manohara’s mother, Daisy Fajarina, held a press conference last Monday, 20 April, in which she said that she has tried to ask the King of Kelantan to persuade his son to free Manohara, but failed. She also said that she has now been banned to enter Malaysia.

Considering the above, Detik reported that the National Human Rights Comission urged the Indonesian government to bring this case to be settled legally according to the Malaysian laws.

It is very sad, especially when we are celebrating Kartini Day, to hear that a girl as young as 16 years old can be allowed to marry someone a lot much older, yet rich & aristocrate, whom she and her mother barely knew.
